SideShop is SideHustle's marketplace where users buy and sell items between themselves. These Terms apply to anyone buying or selling on SideShop, in addition to the general Terms and Conditions and the Privacy Policy.
SideHustle provides the technology platform (listings, messages, offers, payment, delivery and wallet). We are not a seller, buyer or owner of the items, we do not inspect them and we do not guarantee their quality, authenticity or legality.
The sale contract is concluded directly between the buyer and the seller. The seller's obligations (description, condition, delivery, warranties and, if a trader, consumer rights) are the seller's.
To buy or sell you need an account with a complete profile (shop name, photo and country). To sell, the account must be on a plan that allows it and you must provide a bank account (IBAN) to get paid.
SideShop works by market: you only see and buy items from sellers who sell in the same currency as you. The country you choose determines the market.
We may ask for identification, tax or other information that the law requires of digital platforms (including reporting obligations to tax authorities) and refuse or suspend anyone who does not provide it.
The seller warrants that they own the item or have the right to sell it, that the item is lawful and genuine, and that the listing is true and complete: real photos of the item (at least three), condition, brand, size and defects.
You may not list: counterfeit or brand-imitating items, stolen goods, weapons, drugs and controlled substances, animals, adult content, health or safety items without the legal requirements, personal data, and any item whose sale is illegal.
We may remove listings, ask for proof of authenticity and suspend accounts for breaches, without compensation. The seller answers to the buyer and to SideHustle for unlawful or misleading listings.
The seller sets the price. The buyer may propose an amount; an offer only counts if accepted, and the accepted price stays available to the buyer for a limited time in the conversation.
The seller may offer discounts for buying several of their items at once, at the levels they set; the discount is applied automatically to each item's price at payment.
Holiday Mode hides the seller's listings while on; nobody can buy them during that time.
The seller receives the item price with no SideHustle commission. The buyer pays, besides the price, the Buyer Protection fee shown at payment, which covers processing, support and dispute handling. The fee is a service provided at the time of purchase and is non-refundable, unless the purchase fails for a reason attributable to the platform.
Payment is made through Stripe. The purchase is only confirmed when payment is confirmed. If, between payment and confirmation, an item stops being available (for example sold to someone else), the corresponding part is refunded to the buyer in the wallet.
Delivery is to pick-up points (lockers and DHL points). The buyer chooses the point before paying. The seller must ship the item with care, in suitable packaging, within a reasonable time after purchase (we recommend within 5 working days) and enter the tracking code.
If the seller does not ship the item within a reasonable time, we may cancel the order and refund the buyer in the wallet, without prejudice to suspending the seller.
The risk of the item stays with the seller until delivery at the pick-up point chosen by the buyer. The buyer must collect the item within the period indicated by the pick-up point and confirm receipt on the order.
On receipt, the buyer must check the item straight away and confirm receipt on the order. If the item does not arrive, arrives damaged or is substantially different from the listing, they must tell us at geral@sidehustle-club.com within 2 days of delivery (or, if it does not arrive, within 14 days of shipping), with photos and a description. Complaints outside the deadline, or for a mere change of mind, may be refused.
We assess the complaint using both parties' evidence (photos, messages, carrier tracking). If the complaint is upheld, the buyer may be refunded and the item returned to the seller, with return costs borne by the responsible party. Refunds to the buyer are credited to the wallet.
If the seller is a professional (trader), the consumer rights set by law also apply, including the 14-day right of withdrawal in distance sales, which the seller must honour. SideHustle does not guarantee those rights on the seller's behalf.
Dispute decisions we make are in good faith, based on the evidence, and do not affect the parties' legal rights.
The value of your sales and the refunds you receive stay in the SideShop wallet (your balance). The wallet is a record of amounts the platform owes you; it is not a bank account or a deposit, earns no interest and can only be used as set out in this section.
The money from a sale is pending and becomes available 7 days after the buyer has paid. We may hold or delay release where there is a complaint, dispute, suspected fraud or legal requirement.
You can request withdrawal of the available balance to the bank account you provide, above the minimum shown in the wallet. We usually make the transfer in 1 to 3 working days. You are responsible for providing a correct IBAN that is yours; we are not liable for transfers made to incorrect details you gave.
Refunds to buyers stay in the buyer's wallet and can be withdrawn by them on the same terms. We may offset the balance against amounts you owe us (for example disputes, refunds or payment chargebacks decided against you).
If a payment is disputed with the bank or card issuer, or reversed, we may cancel the corresponding credit in the seller's wallet, hold the related balance and withdrawals, and recover from the seller the amount already withdrawn (including by offsetting against future balances). If the balance becomes negative, the seller must restore it.
Buyers and sellers authorise us to share with Stripe, banks and authorities the data needed to answer disputes and fraud investigations. Improper disputes, use of third-party payment methods and fraud lead to suspension and may be reported to the authorities.
Reviews must be truthful and based on a real purchase. You may not harass, threaten, deceive, or arrange payments or deliveries outside the platform to avoid the rules, nor share contact details for that purpose. Messages may be reviewed for safety and dispute resolution.
We may moderate or remove content, reviews and accounts that breach these rules.
To the extent permitted by law, SideHustle is not liable for users' behaviour, for the quality, safety, legality or authenticity of items, nor for delays or losses by the carrier or pick-up point. We do not exclude liability that the law does not allow to be excluded. Our total liability is limited as set out in the general Terms and Conditions.
We may update these Terms with reasonable notice. Portuguese law applies, without prejudice to mandatory consumer rights. Contact and complaints: geral@sidehustle-club.com; Electronic Complaints Book (livroreclamacoes.pt).
